INTOXICATION CHARGE.
UNUSUAL CIRCUMSTANCES.
"The facts in this caee and the circumstances outlined to me by counsel justify me in inflicting a fine instead of sending this man to prison," eaid Mr. C. R. Orr Walker, S.M., in the Police Court to-day, when he fined Ewan Lindsay Jones (25), a clerk, £20 and cancelled his license for two years on a charge of being in a state of intoxication while in charge of a motor car in Federal Street laet night.
Jones, for whom Mr. T. J. Goldstine appeared, pleaded guilty. Counsel stressed the fact that even the police admitted the degree of intoxication was very elight, and that the case was a borderline one. Jones had been a sufferer from infantile paralysis, but had made a wonderful recovery. He had oiily tasted liquor once in his life until yesterday, when he met three other men who were celebrating a birthday, and he consumed one glass of beer in their company. Feeling ill, he decided to sit in the car, which wae not driven.
At counsel's suggestion the magistrate agreed that the fine could be paid by instalments.
