ACTION BY POLICE. STRONG COMMENT BY COUNSEL. (By Telegraph.—Pres« Association.) GISBORNE, this day. The fact that the police did not call as a witness a doctor who had been summoned by them to examine a man charged with intoxication while in charge of a motor truck, was strongly commented upon by counsel in a case heard yesterday by Mr. E. L. Walton, S.M. The accused was Peter Augustus Gordon, who 'was arrested in the early hours of the morning following a collision with a cyclist. Three police witnesses gave evidence that the accused was intoxicated and Unfit to drive, but they admitted that Dr. H. Goulding Rice had stated that he : was sober.

following protests by counsel at the failure of-the police to call Dr. Rice, the doctor was called by the Court. After hearing his evidence the magistrate said there seemed to be an honest difference of opinion regarding the accused's condition. He would give due weight to the opinion of the medical man and dismiss the charge.
