AT SHOP ENTRANCE. I CLAIM MADE FOR DAMAGES. POLISHED SURFACE ALLEGED* A claim for £287 damages and costs arising out of an accidental fall fe plaintiff on a polished floor at the entrance to Fergusson Buildings, Civie Square, on June 8 of last year, came before Mr. W. R. McKean, S.M., to-day when Margaret Scott, of Mangere, proceeded against Fergusson Building. Ltd. Mrs. Scott, who stated that she w 02 years of age, but of active nature and took a regular part in the work of her husband's dairy farm, described her accident. She had been to consult Mr J. M. Adams, and after coming out of the shop she slipped and fell heavily One of her ankles was fractured and dislocated, resulting in her having to he taken to the hospital for immediate attention, and subsequently to have medical and massage attendance for eight weeks. She still limped and could not take the same share in the farm work as formerly. Her medical expenaei amounted to over £70. r«—■«■ At the time of the accident she irar i wearing leather-soled low-heeled shoes, to which she was accustomed. Oatij» shoes were small heel and toe plates. Evidence was led by Mr. F. L. West for plaintiff, that at the place where - the accident occurred the floor sloped, and was of nlbberoid with a 15-mek margin of a polished material, whiek counsel alleged was dangerous on a slope, especially as it had a low step. James Mervyn Adams gave evidence that people had fallen at this spot, both. before and after Mrs. Scott's accident, until the surface was roughened tar ; chipping. ™ FL Hoodie, C..8. Watkin and i W.
