SENTENCE QUASHED.

It is not often that a prisoner on entering the dock is immediately informed that he is a free man, but this morning, after a few brief words by Mr. Justice Smith in the Supreme Court, James Moore had his'freedom.

Moore, a labourer, aged 03, represented by Mr. Noble, had been found guilty in Auckland in July on a serious charge. The case was stated by Mr. Justice Callan in September to be one for the opinion of the Court of Appeal as to whether the prisoner was rightly convicted. The Appeal Court gave its majority finding last Friday, and Moore appeared in the Supreme Court to-day.

"Moore, your conviction has been quashed by the Court of Appeal," said his Honor this morning, "and you are' now discharged." '
