CYCLIST'S INJURIES.

COLLISION WITH LORRY. EVIDENCE OF DRIVER. The claim for damages arising out of a collision between a cyclist, Valentine Dunne (Mr. Bone), superintendent of mails at Auckland, and a motor lorry, the property of Winstone, Ltd. (Mr. Holmden), was continued in the Supreme Court this morning before Mr. Justice Fair and a jury. The plaintiff alleged that the accident, which caused injuries to his leg, was the result of negligent driving of the lorry. He claimed £750 general damages and special damages totalling £138.

Daniel Ryan, driver of the lorry, said that he drove along Britomart Place at about 15 miles an hour. He intended to turn to the right at the Quay Street intersection, and had given the stop sign. Before seeing Dunne on the cycle he had given a sign to a car behind that he was going to turn to the right. When witness gave the stop sign Dunne had arrived at the intersection, and had almost stopped there. Witness added that he immediately dropped his hand and went on, thinking that Dunne was giving him the right of way. Dunne did not give any sign, but v. r itness took it that when he almost stopped he was giving the lorry the right of way. The next thing witness realised was that Dunne was pedalling a course right in front of him at a much faster speed. Cross-examined, Ryan said that Dunne appeared to him to speed up to cross over the intersection to pass in front of him. Prior to that Dunne had slowed up as if he was going to stop, and witness had accelerated slightly. Re-examined concerning the evidence of another motor lorry driver, witness denied that he had told the driver that his brakes must have slipped. The case was adjourned before lunch to enable the jury to inspect the scene of the accident. Counsel and his Honor will address the jury this afternoon. (Proceeding.)
