CLAIM BY MINER.
ABILITY TO WORK. ARBITRATION COURT CASE. The extent to which a miner would be again able to follow his normal vocation was the point at issue in a claim for compensation hCard in the Arbitration Court this morning. Thomas Hen derson (Mr. P. J. O'Regan) was the plaintiff, and the Glen Afton Collieries, Ltd. (Mr. Horc) the defendants. The statement of claim set out that on August 6, 1934, plaintiff suffered an injury while working in the mine. As a result he was totally disabled until November 10, 1934. From November 11 to February 13, 1935, he worked for reduced wages. He claimed a weekly sum of 17/4 as from November 11, 1934, to February 13, 1935, and a weekly .amount of £3 11/9 for the period ending about. September 24, 1935. The defence suggested that from February half compensation should be allowed. Dr. A. Jenkins said that the original injury to the shoulder was due tet the severing of certain nerves. He aid nut think the plaintiff was fit for light, work. Dr. J. Fitzsimmons did not think that the muscle affected would ever fully recover. Dr. E, C. Brewis, of Hamilton, who was called by Mr. Hore, said that work itself was the only test of whether plaintiff would be lit to carry on. Dr. K. S. Macky said that with a residual physical disability of about 15 per cent, plaintiff would be able to continue his work as a miner. The Court awarded plaintiff compensation amounting to £225 2/2.
