WITHOUT LIGHTS.
PARKING ON WATERFRONT.
TRAFFIC OFFENDERS FIXED.
A submission that he was on private property and not on the roadway was made by a young man in the Magistrate's Court yesterday when he was charged with parking without lights in Allenby Road, Mechanics' Bay. Some doubt arose as to whether the information had properly named the road, and it was amended so as to make the charge relate to a highway on the Auckland harbour frontage.
Police evidence was to the effect that the car was parked on the roadway at 12 25 a.m. without lights. The defendant was in the back seat of the car with a young woman. The defendant, in evidence, declared he was on private property —on Harbour Board reclamation—and not on the roadway.
Mr. Wyvern Wilson, 'S.M.: .Then it is not private property.
The defendant said that the car was parked on a section which was overgrown with grass and not on the highway. Hundreds of cars stopped at the spot to admire the view. Sub-Inspector J. Fox: Were you admiring the view? The defendant (smilingly): Oh, well; The magistrate accepted the police evidence and convicted and fined the defendant 10/ and costs. A number of other traffic offenders were dealt with, the charges ranging from cutting corners and riding bicycles without lights to negligent driving. For negligent driving Thomas T. Crabb was lined 40/ and costs, and the magistrate directed that his license be endorsed with a record of the conviction; while Thomas T. Duncan, for a similar offence, was fined 20/ and costs.
