DIN CASE DEFENCE.
APPLICATION TO JUDGE. SETTING ASIDE OF FUNDS. An unusual application was decided by Mr. Justice Callan yesterday afternoon when Mr. Jenkins sought to have a charging order over a certain sum of money held by the Crown set aside in order to provide funds for the defence of two accused persons who arc to etand their trial at the sessions which opened to-da,y.
The case is that in which Laurence Edward Din and his mother, Madeline Elizabeth Din, are concerned in an alleged fraud whereby a total sum of £iSQO was obtained from the Post Office Savings Bank in Auckland. There are several charges, but Mrs. Din figures in one only.
Practically the whole of the £4550 was recovered by the police. The Court made a charging order over the money, and also granted an injunction against the accused negotiating any of the documents. .
Mr. Jenkins yesterday said" his application concerned only one amount, that of £301 10/, a bank draft which he asked to be released. He said the accused's counsel would undertake t}iat nothing released by such order would be retained by him and would be used only in payment of such costs and disbursements incurred in the defence in the criminal prosecution as might be allowed by the resistrar of the Court. Later in the afternoon hifl Honor issued the order as requested.
