REMARKS BY MAGISTRATE. WASHINGTON, September 8. The German Ambassador to the United" States, Dr. Hans Luther, called at the State Department and lodged an official protest against the action of the New York magistrate, Mr. Louis Brodsky, who is a Jew, in dismissing five Communists accused of unlawful assembly in connection with the antiNazi rioting on the German liner Bremen in July. It is understood that Dr. Luther emphasised his Government's annoyance at the magistrate's biting comments on Nazi-ism in dismissing the cases. The Secretary of State, Mr. Cordell Hull, who had hoped the matter was closed with his previous Note of regret, referred it to the Governor, Mr. Herbert H. Lehman, for a report.
