FORFEITURE APPLICATION.

PEGGING OF THE GROUND. (By Telegraph.—Own Correspondent.) THAMES, this clay. . The further hearing of the claim made by W. H. Hughes (Mr. E. J. Cleftdon) for the forfeiture of the Whitehaven and Carlysle claims held by A. P. Sawyer and A. J. Boyle, respectively (Mr. A. G. Bryan), took place before Mr. J. H, Levieii, S.M., yesterday. H. W. Lloyd said he inspected the pegs on July 7. " There was only one peg on the 'Whitehaven claim. It was about a chain out of position and not properly marked. He found pegs on the Carlysle ground, only one being properly marked. A. J. Boyle stated that he had held the claim since 1933 and he hoped to raise capital to work the ground soon. After taking up the ground he gave an option to Hughes, but he could not state the terms. He recently saw that pegs were properly marked. Ho paid his uncle, A. F. Sawyer, to peg out the claim. He could not explain why more acreage was pegged than he had applied for.

A. F. Sawyer said he was owner of the Whitehaven claim and when pegging out the ground he honestly believed that he was only taking 20 acres. He interviewed the Minister of Mines about testing the ground by boring, but found that it was too expensive.

Legal argument ensued, when counsel quoted eminent authorities and sections of the Mining Act.

The magistrate reserved his decision.
