GUARANTEED ACCOUNT.
SUPREME COURT JUDGMENT. Judgment has been entered for the plaintiff for the full amount of the claim in the case in which Bond and Bond, Ltd., merchants, of Auckland, sought the sum of £104 10/11 from Henry Rothery, contractor, of Te Kuiti, before Mr. Justice Herdman, in the Supreme Court.
Mr. W. R. Tuck appeared for the plaintiffs and defendant was represented by Mr. E. W. Inder.
In his written judgment delivered this ijiorning, his Honor said the claim was made -by the plaintiffs to recover the money under an undertaking entered into by. the defendant to become answerable and responsible for the due payment by a firm of grocers called Foley and Reidy of money payable by them to the plaintiff for advances made and goods supplied. The instrument which defendant signed, said his Honor, in which he undertook that no waiver or indulgence granted to the principal debtor should absolve him from liability, and an express reservation left no doubt in Ills Honor's mind about his obligations.
