COSTS MUST BE PAID.

(By Telegraph.—Press Association.) WELLINGTON, Wednesday. The question whether the Court had power to refuse to make a decree nisi absolute on a respondent's motion unless and until the respondent paid the petitioner's costs, as ordered by the decree nisi, was decided by Mr. Justice Ostler in the Supreme Court to-day. His Honor held that the Court has such power. The petitioner in the suit for divorce was Ellen Irene Dimery, and the respondent Arthur Thomas Dimery.

His Honor said that respondent wanted to take advantage of one part of the decree nisi, while not being willing to comply with another part. He adjourned the application sine die lintil the costs of the petitioner had been paid by respondent.
