QUESTION OF REDUCTION.
CASE IN APPEAL COURT.

The Court of Appeal is to-day hearing an appeal of St. Mungo, Ltd., from tlie ordrr of Sir Alexander Herdman, made at Auckland on February 24, 1933, fixing Ihe rent of premises occupied by .T. ,1. Craig, Ltd.. respondents in the present appeal. The appellant company is the owner of property in Queon Street, Auckland, leased in 1917 to .!. .1. Craig, Ltd., for :!() years at an annual rental of £.H'>22 10/. The respondent company, which carries on tlie business of a merchant, applied to the Court under part :! oi' the National Expenditure Adjustment Act. I'.V.VI, to have the rent of tlie property fixed according to the terms of the Act. After tile matter had been considered by tin- Auckland Adjustment Commission the rout was ordered by the Court to l>c fixed at £2120 per annum. The appeal was now .brought from this decision. For the appellant, Mr.- 11. E. Barrowclough appeared, and for the respondent, Mr. .1. Stantiin and Mr. E. .1. V. Dyson. On the Bench were the Chief Justice, Sir .Michael Myers, Mv. Justice MacGre.ijor and .Mr. Justice Smith.
