UNREGISTERED CAR.
OWNER FINED AT OTAHUHU
"This is a most peculiar case, and I have not listened to sucli hard swearing for quite a. long time," commented Mr. F. H. Levien, S.M., in the Otahuhu Police Court yesterday afternoon, when William H. Nicholas, of Howick, was charged with using an unregistered motor vehicle and permitting an unlicensed vehicle to be used.
Sergeant J. Cabill said defendant was charged with transferring the number plates from a registered ear to an unregistered car, which he used for conveying calves to Westfield. Defendant owned an old car, and his daughter, Mrs. Sommerville, also owned a similar car. Her car was registered; defendant'* was not. Evidence was given by Constable John Devereaux and several others. Mr. Holmden, for Nicholas, said defendant had two places to look after. Defendant and his daughter had cars of similar design, and defendant decided not to register his car, as one was enough. He had never taken his car off the premises and he denied ever changing the number plates.
Defendant pave evidence, and was supported by his daughter and Robert Nicholas.
In convicting Nicholas on the charge of using an unregistered motor vehicle, the magistrate said, "The defence is asking me to believe that the constable went to a particular place and built tip a strong story without any foundation of truth at all. Defendant's car was supposed to be a derelict—no benzine, no battery—and yet the constable had no difficulty in starting and driving it.'' Counsel stated liiis intention to appeal. Defendant was fined £5 1/3, and costs 34/0.
