UNUSUAL MOTOR COLLISION.
PROBLEM FOR MAGISTRATE. "EVERYBODY PLEASANT AFTER." With all parties agreeing that it was a mysterious accident, Mr. F. H. Lcvicn, S.M., was called upon at the Otahuliu Court yesterday to give judgment in the case of the police against James Graham, who was charged with negligent driving and failing to keep to the left of the centre line. He pleaded not guilty.
S. I. Moe, of Papatoetoe, said that on January 14, as he was driving through Wiri in his motor car about 10 p.m., he was hit by a car driven by defendant on a bend in the vicinity of Wiri Post Office. Both of them had been on their correct sides, but defendant must have swerved into him in parsing. It was difficult to know what happened.
Defendant said he fainted after the smash. Afterwards he heard Mr. Moe say Miss Hunter, who was sitting beside him, grabbed his arm just before the impact.
One of the other witnesses said that after the collision "everybody was particularly pleasant to each other, and relieved that no one was hurt."
In convicting defendant on the charge of negligent driving and dismissing the other, Mr. Levien said both parties were too close to the centre line. The weight of corroboration was with Moe. Defendant at the last moment had turned to his right. He would be fined 30/ and costs 39/.
