ACTION FOR £447,000. (Received 2 p.m.) : LONDON, December 7. After a hearing extending over 10 days, Mr. Justice Branson in the King's Bench, delivered judgment in favour of Unilever, Limited, Lever Brothers and a Norwegian Company; against the Norwegian whaling companies, Polaris and Globus, who sued for £447,000 on an alleged breach of contract. " Plaintiffs contended that defendants agreed to take the whole Antarctic catch of .whale oil for the 1930-31 season, even if it exceeded the carrying capacity of the factory ships, and was brought to Europe in tankers. , 'Defendants con : tended that the liability extended to oil which factory ships produced, store J, carried and delivered. -

Mr. Justice Branson pointed out that factory ships were capable of -producing 21,000 barrels to a value of £875,000, but the carrying power was 118,500' barrels valued at £483,750. Between the dates of the contract and the refusal of the oil the price slumped from £25 to £12 10/ a.ton. He gave judgment that the word "cargo" in the contracts meant only what the shipe were abte to produce ,and carry.
