QUESTION OF DATES
PRISONER STOOD DOWN.
A request that Mr. Justice Jlerdinan should state a case for the Court of Appeal in connection with the jury's ver lict of guilty of indecent exposur returned against Thomas James 0 Hnga was made by counsel when the prison ippeared for sentence in the Suprei rvmrf. 'fin-da' l Counsel said that the prisoner had 3 een indicted with committing offences on two different dates and a verdict of had been returned in a second trial. At-the first trial several young girls called in support of the Crowns Sase were unable to give any and the indictment had to be amended Again in the second trial the children could gne o dates. This.embarrassed the accused man in his defence, because he was unable to produce certain evidence. In reply to J a question by Ms Honor counsel said this.evidence would nave the ffect of showing that O'Hagan had lent hU motor vehicle to someone else, on tue Xch.he was alleged to have been seen near it. For the Crown it was submitted that oai the question of date. - His Honor ordered that the prison?.
