DENTAL SUPPLIES DISPUTE.
SETTLED BY AGREEMENT.
IN AUCKLANDEE/S FAVOUR.
A Supreme Court action of considerable interest to the dental profession and others was heard and adjourned in December, and after eight months' negotiations between the parties has been settled.
Dentists' Supplies (Australasia), Ltd., claimed from Noah Cohen, of Auckland, a total of £8065 damages, including £2000 for alleged fraudulent misrepresentation, £5000 for alleged wrongful cancellation of agency rights, and £1000 for alleged breach of duty as manager. Counsel for plaintiff asserted that the whole thing was a scheme otl_ defendant's part for selling an agency and then killing the company in order \ to get the agency back. After a hearing occupying _ nearly two days, during which two witnesses for plaintiff were heard, Mr. Justice Smith suspended the proceedings to enable the parties to confer. Defendant subsequently counter-claimed for a sum of £9500, but the litigation has been ended in the past fortnight by plaintiff agreeing to pay defendant the sum of £200, and to transfer to the defendant the New Zealand assets of the company, together with rights and royalties held under existing agr eement arising from the agency, Involving a dental baseplate "material supplied by a German company.
