UNDESIRABLES.
MAN FROM AUSTRALIA. " SHOULD BE DEPORTED." HABITUAL CRIMINAL. "We don't want this country to be inundated by Australian criminals, or by any other criminals," said Mr. Justice Herdman in the Auckland Supreme Court to-day, when a seaman from Australia, Arthur Martin Wellington (49), who was an habitual criminal, stood in the dock for sentence on a charge of theft. His Honor said it appeared that Wellington was an undesirable immigrant. Mr. Hubble (for the Crown): He was an habitual criminal in custody in Melbourne until 1930. His Honor: There is not sufficient information before me to show whether the facts warrant that an order should be made, but this man should not have been allowed into the country, and he should be sent away. Mr. Hubble-said'that the Act did not give the necessary power to order that the prisoner be deported.
His Honor: The proceedings would have to be taken by somebody else. He conies within the definition of a prohibited immigrant, and steps should be taken to have him deported. The prisoner was stood down for a week to decide what should be done.
