STOUT DEFENCE.

OLD MAN ATTACKED. "USED MY STICK ON THEM." ASSAILANTS SENT TO GAOL. Tam not going to have old men assaulted like this," declared Mr. F. K. Hunt, S.M., in the Police Court this morning when imposing terms of imprisonment on Walter John Wade, aged 36, a fireman, and Archibald McInteer, aged 31, a blacksmith, on a charge of assaulting an old ago pensioner named Andrew McLuckie. In evidence complainant stated that while in a convenience in Hobson Street at 6.15 last night accused had sought to get into conversation with him. This lie resented, stating that he did not want to talk to "the likes of them." "They refused to allow me to leave aud one of the men tried to strike me," added witness. "I warned them that I would use my stick on them. One attempted to hit me again, and I broke my stick on his head. I later put him on his back and gave him another crack." The arresting constable stated that complainant had pointed out accused to him in Albert Street shortly after the incident. Both men were under the influence of liquor and denied all knowledge of the assault. "Did either accused have any marks on him ?" inquired the magistrate, Mr. F. K. Hunt. The constable replied that one man had a cut on the side of his face and a bump on his head. Accused made statements denying the offence charged, adding that they were nowhere near the scene of the' alleged assault. Detective Sergeant Kelly said that Wade had a "list," but the other man was unknown to tho police.

Wado was sentenced to one month's imprisonment and Mclnteer to 14 days'.
