TEST MATCH TICKETS.
CLAIM AGAINST RUGBY UNION LOSS. IN COMMISSION. (By Telegraph.—Press Association.) - ' WELLINGTON, Tuesday.
The case is proceeding Mr. E. Page, S.M., in which Gerald Bell is suing the Wellington Rugby Union in respect of seats which he did not obtain foxclients on the occasion 'of the fourth Test match against the British Rugby team as the result of alleged priority not being maintained. The claim is for the commission on the lost sale of 144 tickets at 1/6 each (£lO 16/), £54, representing payment of 30/ each to 36 persons employed by him to make purchases, and £20 general making a total of £S4 16/.
It was stated for plaintiff that he had established a theatrical connection in purchasing tickets for clients, and it Avas . claimed that the onus was on theatrical companies to see that priority was maintained, and that they did so, and that the legal position, in regard to the Rugby Union on this, occasion was the same.
In reply to the magistrate counsel said the claim was on the basis of breach of contract. Plaintiff employed 182 men to purchase 749 tickets. The evidence so far includes a theatrical box office employee, who said it was his duty to see that the order was maintained on the occasiop of queues for his firm's-performances, and 'Barnard George Griffiths, who said he was the first man in plaintiff's set and the 29th in the whole queue. In his opinion not more than 260 people purchased tickets. Plain biff himself, giving evidence, said he told Murphy, a member of the Rugby Union, that they ought, to number the queue. Murphy replied' that theyvwere running the show and it was a case of first come first served.
/ For the defence it was submitted that! plaintiff must be nonsuited, as the only contract in existence was that between plaintiff and his clients, with which tlie union' could not be concerned. The magistrate, Mr. E. Page, reserved decision on the nonsuit point. CANTERBURY UNION'S LOSS. AFFECTED BY BRITISH TOUR. ■ i (By Telegraph.—Own Correspondent.) CHRISTCHURCH, this day. "We will show a loss on -the year's working," declared the president of the Canterbury Rugby Union, Mrl A. E. McPhail, at a meeting of the union's management committee, when a short statement of the finances caused considerable discussion. The president stated that the union had suffered financially by the loss of three playing Saturdays through the visit' of the British team, and the trial match. The game against Wanganui had had to be abandoned. Thi3 made the union s year very lean as far as finance! was concerned. Then Mr. A. E. Fowler said, "Some people think that we make thousands of pounds," whereas we are running at a loss. We got nothing from the British matches here."
