A charge of the' the#/ of a box of mussels, valued at 18/, preferred against Patrick Knox, was dismissed by Mr. F. K. Hunt, S.M., in the Magistrate's Court this morning. Knox appeared on summons and through his counsel, Mr. Bryce Hart, pleaded not guilty. Joseph Best, a bottle gatherer, declared that he had seen accused, carry away the box of mussels on July 17.
William Henry Clark, a dealer in mussels, said that when he was informed of the alleged theft, he accosted Knox and asked him to return the mussels. Knox, however denied knowledge of the shellfish, and waited with witness till a constable arrived and he was given in charge. In evidence Knox denied that he had taken the mussels. He had a parcel of six bottles of oysters with him, he said, but these he had secured at his place of employment. As no mussels were found on accused, the charge was dismissed.
