CYCLIST'S CLAIM.
KNOCKED DOWN BY CAR.
SUM OF £933 SOUGHT,
A twisted' bicycle that looked fit only for the scrap heap Was propped Up against the dock at the Supreme Court this morning when a cyclist claimed £033 from a motorist. The claim was contested in May last when the jury disagreed. Plaintiff was Edward Francis Hiekey, aged 37, a railway signalman, of Green Lane (Mr. Noble), and defendant was Hush C. Grierson, architect, of Auckland (Mr. West). The statement of claim set out that the accident occurred shortly before 11 p.m. on December 30, when plaintiff was knocked down at the intersection of Mapau Road, and Great South Road, by a car driven by defendant. Plaintiff alleged that the motorist was on his wrong side of the road, travelling at an excessive speed, and had failed 'to keep a proper lookout. The defence was a denial of the charges and alleged contributory negligence on the part of plaintiff. Mr. Justice Smitli Was on the Bench. (Proceeding.)
