BAKERY LEASE DISPUTE.
MISREPRESENTATION ALLEGED SUPREME COURT ACTION. A claim for £150 general damages for alleged fraudulent misrepresentation on the lease of a bakery business was made by Peter Elder Ramsay, baker, of Opotiki, against Thomas Alfred Leonard Mitchell, of Auckland, before Mr. Justice Smith in the Supreme Court this morning. A counter-claim for £577 10/ damage--, for alleged los of rent and £32 arrears of rent was made'by Mitchell: ■' In his statement of claim, the plaintiff said he had' leased from the defendant a shop in Manukau Road, Epsom, to be used as a bakery. Ramsay claimed that he was induced to lease the premises by a fraudulent misrepresentation of fact and suppression of fact. The defendant, it was contended,' had represented that the business site was an exceptionally good one, and that all the business people in the block were well. The plaintiff- alleged that material information regarding former tenants of the shop was not "given him by the defendant. (Proceeding.)
