COMPENSATION COURT.
SITTING AT PUKEKOHE. AREA FOR SCHOOL PURPOSES. A sitting of the Compensation Court wae held at Pukekohe yesterday, Mr. F. H. Levien, S.M., presiding. Associated with him were Mr. W. Wallace, assessor for the Auckland Education Board, and Mr. D. R. Hamilton, assessor for Mr. Malcolm Mclntyre, of Aka Aka. The Education Department, for the purpose of securing land for a bigger playing area at the Aka Aka school, took two acres of Mclntyre's property under the provisions of the Public Works Act, for which it offered him £150. Mclntyre claimeU £240, made up as follows: £150 for the -land, £25 the cost of fencing, £75 depreciation to his property. An area of between 30 and 80 acres, it wae claimed, would be affected through loss of frontage. Mr. A. L. Tompkins appeared for Mclntyre and Mr. A. J. Towle for the education authorities. Mr. • Towle said Mclntyre did not desire to part with the land and he had pointed out to the Minister of Education and the Department this fact. Mclntyre had taken hay off the land for many years. The severance meant his frontage would be reduced from 16 to 12 chains, and consequently it would detrimentally affect a 40-acre block. Expert evidence having been given as to the value of the land, the Court allowed Mclntyre £120 for the two acres, and £20 compensation for severance. Each party was ordered to pay its own costs.
