BID FOR WRONG CAR.
FARMER"S MISTAKE AT SALE. VENDORS CLAIM REJECTED. (B.v Telegraph.—Own Correspondent.) WAIHI, this day. A misunderstanding at an auction sale appears to have caueed an action heard in the Magistrate's Court yesterday. when J. Monk, of Hamilton, merchant, claimed from Thos. Leach, of Waihi. farmer, £8 for a second-hand car. The evidence showed the ear Hold to defendant was in a shed near where the auctioneer stood. There was another car outside in the yard, which defendant took to be the car that was being sold. Bids started at £•">. and the car was eventually "knocked down" to defendant. He refused to take delivery, and described the car sold to him as a "scrap-heap." A reserve of £70 had been placed on the other ear, which defendant thought he was purchasing. The magistrate said it was a ease of an inexjKrieneed farmer wanting to purchase a second-hand car. and seeing a car standing outside in the yard thought lie wae bidding for it. It was feasible that a mistake was made, and that defendant and the auctioneer were not dealing with the same thing. Judgment was given for the defendant, with costs.
