NEW TRIAL ORDERED.
CASE AGAINST MAORI. DISAGREEMENT OF JURY. The jury empanelled in the Supreme Court to consider the charges of carnal knowledge lodged against Hira Eruera, a Maori, aged 20, failed to agree after a retirement of four hours and a quarter, and his Honor Mr. Justice Blair ordered a new trial to take place at the next criminal spssion. The girl concerned in the case, a niece of accused, was 141 years of age. She kept house for Eruera, following the death of his wife.' His Honor ob.-erved that the girl had been an unsatisfactory witness, and had the case depended solely on her it would have been his duty to tell the jury that it would be unsafe to convict. On the other hand the Crown had not a monopoly of unsatisfactory witnesses as Mr. Singer (representing accused) had made reference to the singular mental incapacity of his own client.
