CHARGES DISMISSED.
AIXEGED ASSAULT ON GIRL
EVIDENCE UNSATISFACTORY.

The charges against Victor Ashby of having committed an indecent assault and an aggravated assault on a girl, aged 19, on August 19, were dismissed After hearing the evidence of Constable Holland, Mr. Levien, S.M., said there were unsatisfactory features in the evidence for the prosecution. If the complainant resented the alleged attentions of the accused it was reasonable to suppose that she would have actively resisted when he first accosted her. Also, it would have been thought that after he left her she would have continued straight on home.
Mr. Levien said there were several inconsistencies in the evidence of defendant's witnesses. He was quite confident that no jury would convict accused and it would be a waste of time and expense to send the case for trial.
