NEGLIGENT DRIVING.

CYCLIST BADLY INJUAED. SUBSTANTIAL DAMAGES AWARDED. Decision was given by Mr. W. R. McKean, S.M., in a case in which damages were claimed by a cable electrician named John Melville Grocer (Mr. Bloomfield), from Mervyn Millett and Elizabeth Waite (Mr. Schramm), for injuries claimed to have been due to the negligent driving of Mervyn Millett, servant of Mr?. Waite. The claim was originally for £333, but was reduced to £300, to bring it within the jurisdiction of the Magistrate's Court. Plaintiff was riding a motor cycle at 10.30 p.m. in Symonds Street, when he was run into by a car driven by Mervyn Millett. He suffered injuries, and his hospital expenses totalled £60 12/6. There was also a claim for repairs to the motor cycle, ar.d £200 general damages were asked for. Medical evidence was given to the effect that plaintiff would not be fit to do heavy work for some time yet. also that there might be some permanent after-effect owing to the break being near the ankle, not so much of a character to interfere with his working, but in social matters. Mr. McKean held that plaintiff was entitled to, succeed, and gave judgment against defendants for £218 14/4, with coets.
