INTOXICATED MOTORIST

DUNEDIN, Friday.
Thomas Butler, charged in the Police Court with being in charge of a motor vehicle while in a state of intoxication, was fined £10 and 30/ witnesses' expenses. '
Five witnesses declared that they had seen Butler at various times during the day ranging from about 2 p.m. until 8.20 p.m., and that he had shown no signs of being intoxicated.
Mr. J. R. Bartholomew, S.M., said the evidence of a number of witnesses for the defence was negligible, because they had seen accused earlier in the day. The evidence of the constables was very positive. The condition of accused could perhaps be defined as being just over the border line. He would not prohibit Butler from driving.
