GARAGE AS DWELLING.
FOR TEMPORARY OCCUPATION DISCUSSIOX AT MAXTREWA. Considerable discussion took plaee at a meeting of the Manurewa Town Board last evening, on Mr. E. T. Rails' request tor permission to occupy, as a temporary dwelling, a newly-erected garage on Berkeley Park Estate, Homai. The applicant explained that necessary sanitary arrangements had been madeEventually it was decided to accede to the request, subject to the satisfaction of the building inspector (Mr. B. Yeoland), and the rendering of a bond of £50 to vacate the building if called upon by the board to do so after twelve months.
In reference to Mr. T. J. Corin's contention that, being a builder executing a contract for a purchaser, he (Corin) was not responsible for the procuration of a habitation order, the clerk (Mr. H. Kay) read an opinion on the matter obtained from the board's solicitors (Messrs. Fitchett, Rees, and Luxford). This opinion coincided with Mr. Corin's statement, adding that any action taken must be against the occupants, who should have obtained an order prior to ocupation. Further, an alteration and addition to the by-law to cover the matter was suggested. It was decided to incorporate same in the building by-laws at a later date.
