AN ALTERED PLEA.

GUILTY OF COMMON ASSAULT. REMANDED FOR SENTENCE. * About a year ago there was an affray in Victoria Street which resulted in a man named Andrew Souter receiving fatal injuries. Colin McDonald was charged with manslaughter, but as he had gone to Sydney, it was some timo before he was apprehended and brought back. Yesterday afternoon McDonald pleaded guilty, before Mr. Justice Herdman, to common assault. The Crown accepted the plea. Mr. Singer said the accused was one of three young men concerned in the trouble, and it was questionable whether the accused did strike the fatal blow. The men were under the influence of liquor at the time and no one could speak plainly of what happened. Accused did not leave New Zealand with the idea of evading trouble. He did not know Souter was dead. Under the circumstances, counsel suggested that probation should be granted. Tbe accused was remanded until Wednesday on bail.
