SUPREME COURT.
A FATHER'S APPLICATION. CUSTODY OF CHILDREN. At the Supreme Court this morning, before Mr. Justice Stringer, an application was heard on behalf of David John Cook, labourer, for the custody of two children, aged nine and seven years respectively. Mr. J. F. TV. Dickson said that the petitioner obtained a divorce in May, 1923, and it was agreed that the two children of the marriage should remain with their mother, who was living with her mother at Palmerston North. Suoe then the respondent had married again. There was one child of the marriage. The petitioner was waiting for c. Government loan, and as soon as he obtaieed it he' intended to get married. His Honor said that a good deal ffould depend upon the suitability of the new wife to exercise parental control over the two children. He did not think that a single man, working as a labourer, would be in a position at the present time to take charge of them. Heptane, for the application would be when he could offer them a home.
Mr. i-W. F. Conlan said that the riglrts of the mother had also to be considered, as it would be a serious step to remove the children to new mrroieidings. His Honor said that he would not grant the application, but when petitioner established a home the application could be renewed. The case w»i adjourned sine die, the question of costs being reserved.
