MARRIED AGAIN.

THOUGHT HIMSELF DIVORCED AN AUCKLAND APPEAL. (By Telegraph.—Press Association.) WELLINGTON, this day.

The Court of Appeal, both divisions -sitting, is now considering the case, Rex v. Thomas Clarence Carswell, on which the judges could not agree when it came before the Court on August 1 of last year.

At the trial of accused at Auckland in February, 1925, it was proved or admit - ted that he went through a form of marriage when to his own knowledge ht3 first wife was alive. He set up Cie defence that at the time of contracting the second marriage he honestly and on reasonable grounds believed that he had been divorced from his first wife, and evidence was called along these lines.

The jury found that he had honest grounds for his mistaken belief, but tbe directed them to return a formal verdict of guilty and reserved the question of law as to whether the finding of the jury constituted a good defence to the charge preferred.

By consent, written argument is bein<* submitted to the Court.
