MOTOR CAR COLLISION.

$ ON A FLOODED ROADWAY,

Mr. E. C. Cutten, S.M., had to decide, it the Magistrate's Court, a case arising out of a claim for damages following upon a motor car collision. James Anner, of Pokeno (Mr. .Tordon), cued C. C. Otway (Mr. Holmden) to recover £33 10/ for damages alleged to lave been sustained owing to a collision duo to the negligence of defendant. For repairs £23 10/ was claimed, and another £10 as general damages. The collision occurred near Mangatawhiri Bridge.

A number of witnesses gave evidence for the plaintiff, including the local (Constable.

The defence was a denial that the collision was due to the negligence of Mr. Otway. Defendant's statement was that his car was almost stationary. Plaintiff came along at a good speed, and the collision occurred. The country was in flood at the time, the water being nearly up to the roadway. Mr. Otway said he eased up his car. and there was ample room for plaintiff to have passed.

Judgment was entered for the plaintiff lor £33 with costs.
