, SCHEME THAT DID NOT MATURE. Judgment by Mr. E. C. Cutten, S.M., was read this morning at the Magistrate's Court in a case brought by L.G. Watson against P. S. Gee (Mr. Kealy) to recover £82 10/, alleged to be due as fees paid to an architect. was made by a'builder for work done in preparing plans and specifications and estimating costs of a building. Defendant consulted plaintiff about erecting buildings on his property at Milford. They discussed a fairly comprehensive scheme involving the erection of a building to cost something over £3000. Defendant then instructed plaintiff to have plans and specifications prepared, and an estimate made, to enable him to see if that large proposition could be financed. Plaintiff instructed a firm of architects, to prepare plans and specifications for ■ such a building. That was done, the estimated coat being £3300. Plaintiff handed these plans to the defendant, who did not communicate further with him. The following year plaintiff found that defendant had erected a new building on the property at Milford. Plain- , tiff now sought to recover the actual fee ; claimed by the architects. . ,' Defendant's answer was that he [: apprised ■ the plaintiff . when the plans were brought to Mm that he had no .; intention of "going as far as that." '■ Defendant, however, admitted he used , the plans for the purpose of endeavour- . ing to raise money to finance the build- , ing.
