A SECOND MORTGAGE.
MISREPRESENTATION ALLEGED., -j . A claim for the recovery of £300 on the ground of alleged misrepresentatioi' regarding the value of a second mortgage over a property at Pukeatua was made by Mrs. Mary Isabella Monteflore. of Te Awamutu (Mr. Gillies), in the Hamilton Supreme Court yesterday, against James Gladwyn Holmes, garage proprietor. Te Awamutu (Mr. Swarbrick). Plaintiff stated that in November, 1924, she made an exchange, with the defendant, and in payment received a transfer of a second mortgage securing £240 and interest from one F. H. Solomon. Defendant represented that tho mortgage was a good one, that there was ample security for it, and that the interest due had been paid. It was contended that, the representations wero false. > ' Defendant denied having represented that the mortgage was a good one, and that there was ample security. He stated that the plaintiff and her solicitor knew the interest had not been paid. Mr. Justice Herdman said the "evidence did not disclose that there had been misrepresentation, and nonsuited plaintiff. '- ; ~ '
