ASSAULT AT WAIHI.

MAN SERIOUSLY INJURED. STRUCK WITH A GAS RING. BROTHER AND SISTER FINED. (By Telegraph.—Own Correspondent.) WAIHI, Tuesday. As a result of a fracas which occurred in the east end of the town on September 4 last, Elizabeth Guy and Cyrus Lewis (brother and sister), were charged in the Magistrate's Court to-day with assaulting William L. Rudd, a well-known professional boxer. Mr. Clendon appeared for informant and Mr. Beeche appeared for accused, who pleaded not guilty. The Court was crowded, and the evidence of the prosecution showed that iDowns and Rudd had. words over a cheque and a fight resulted. Downs was outclassed, Rudd merely hitting him with an open hand. Both shook hands and had a drink, Downs going home. Later Mrs. Guy, who is Downs' housekeeper, came to Rudd's house, and when the door was opened by Rudd, she struck him on the forehead with a poker. Rudd grabbed the poker, and was then stuck by Lewis with a gas ring several times on the head. Serious injuries resulted and Rudd was admitted to hospital. His condition at one time was precarious. The defence was that any injuries inflicted were justified by provocation and obscene language usedLewis, in evidence, said that when he struck Rudd with the gas ring, the latter had his sister by the throat, and he acted in her defence. Accused was submitted to a searching cross-examination. Mrs. Guy swore that Rudd used obscene language to her. She then struck him with a poker. The Magistrate, giving judgment, said Rudd was entitled to the protection of the law. Mrs. Guy evidently went to Rudd's place to punish him, and a serious fracas developed, Rudd being seriously injured, and it was a wonder he was not killed. He (the Magistrate; was not satisfied with the plea of provocation. Lewis would be convicted and fined £10, with costs, and Mrs. Guy, who took a minor part in the assault, would be convicted and fined £5, with costs. Half of the fine in each case was apportioned to Rudd. == - =r_____
