POLICE COURT.
(Before Mr. F. K. Hunt, S.M.) CHARGES DISMISSED. When charged with fighting in Customs Street yesterday, John McMahon (27), and Charles Tanner (23), each pleaded not guilty.
Constable Patterson said that while on points duty he saw the two accused fighting with another man. When witness approached them the other man got away.
McMahon explained that "a big joker" came up and hit him over the head, so he hit him back.
The magistrate gave both men the benefit of the doubt, and dismissed the charges against them. "Anyway they have been in all night," added Mr. Hunt. A SHIP DESERTER. Anton Hlavaka. (27), a Slovakian, who pleaded guilty to a charge of deserting from the s.s. Penmorvah, was remanded for one week and was ordered to-be placed on board the vessel when it sails from Auckland. DISORDERLY WHILE DRUNK. "This man usually §°ts in a disorderly manner when he gets a drop of drink in," said Senior Sergeant Edwards about Charles McGeahan (53), who admitted that he was disorderly while drunk in Fort Street yesterday. The senior sergeant added that McGeahan was holding on to motor cars in th<j street. "The trouble is that people call mc Horses Head and other names,"' said McGeahan. He was fined £1, or three days. BREACHES OF PROBATION. A youth named Allan Kirkwood. pleaded guilty when charged "with having failed to comply with the terms and conditions of his release on probation. The Probation Officer (Mr. W. J.
Campbell), stated that accused, had been admitted to' probation on May 22. but had persisted in associating with others ■ who were on probation, contrary to the terms of his release on probation. Mr. Campbell said that he was experiencing:.. trouble with pangs of hoodlums in Xewton and Grey Lynn. The.s-e must be broken up. Mr. Hunt agreed with the Probation Oflicer and fined Kirkwood 30/. Cflariee Adelaide Wynne (211, was also charged with failing to comply with the terms and conditions of her release on probation. The Female Probation Officer (Adjutant Gordon), told the magistrate that accused, who had been admitted, to probation on June 4 last, had left service and had come on to Auckland. She had failed to report. Accused had made the excuse that she was not aware of the conditions. Mr. Hunt adjourned the case for one month, and advised the young woman to adhere strictly to the terms of her probation, otherwise she would be sent to gaol. ILL-TREATED A HORSE. A young Chinaman pleaded guilty to havinsr cruelly ill-treated a horse. Evidence was given that defendant had been seen striking the animal, which was in poor condition, over the head with a whip handle. He also kiqked the horse and threw stones at it: Mr. ,Hunt: T always thought that treated their horses very well. He will be. fined £.5 and costs.
