DUNDAS MACKENZIE'S APPEAL
NO CASE MADE OUT. ' .1 RESPONDENT NOT CALLED ON. f3y Telegraph.—Press Association.) WELLINGTON, this day. At the Appeal Court in the Dundas Mackenzie case, the Chief Justice, Sir Robert Stout, stated this morning that since hearing Mr. Myers on Friday, the Court had had the opportunity of considering the evidence, and thought it unnecessary to hear counsel for respondent, and that the judgment of the Court below should not be disturbed. The appeal was dismissed, with, costs on the highest scale. The Court added: We shall put into writing, later, our reasons for the conclusion arrived at by us..
The question of the costs of the proceedings in the Supreme Court was not determined by Mr. Justice Herdmau, and that is left open for consideration by him.
