OWNER CLAIMS DAMAGES

A rather unusual case came before Mr. F. K. Hunt. S.M., to-day at the Masistrate's Court. Maria Boric (Mr. Blakey) sued the Kaipara Wine Co., and G. Hewlett, to recover £50 as damages for putting furniture out of a building, and leaving it exposed to the weather.

The representative of the defendant company said the plaintiff .had no right to storage on their premises. They wrote to plaintiff asking her to remove the furniture within 14 days, or she would be charged ten shillings per week rent. As the furniture was not removed it was put out under a tree. The company did not think it was under any obligation to store the furniture. Mr. Hunt: You had better pet legal advice, or you may find yourself cast for damages. It was explained that £1 had been sent to plaintiff to pay for the removal of the furniture, and as no notice was taken, it was put outside the premises. Mr. Hunt said there were two sewing machines amongst the goods left exposed to the weather. Defendant said the furniture was two months under a fig tree and diving that time no rain fell.

Mr. Uowlett, senior, here rose in the body of the Court and said the furniture was first left under his house. The Public Trustee had put plaintiff out of a house, and the Kaipara Wine people took the premises. That company had done everything possible to get the plaintiff to remove the furniture, but she refused to do so. Mr. Howlett said he told plaintiff the furniture could not remain under his house, and she paid his son to shift it over to the defendant's premises.

Mr. Hunt at this stage adjourned the casp to enable defendants to instruct counsel.
