PONT THAT WOULD NOT GO RIGHT. Mr. F. K. Hunt, S.M., dealt with a I case this morning a t the Magistrate's '■ Court, arisins out. of a horse deal. H. ! A. \Valkingshan- of Tapakura (Mr. I Holmden) sued J. C. Olland of Papa-! toetoe Ofr. Fleming:), to recover the 1 sum of £14, alleged to be due as money , received. Plaintiff stated that he bought a pony! from defendant for £14. The pony was I not suited to his requirement* 'as it shied, and was frightened at the train. Defendant supplied another pony, which plaintiff stated was worse than the first' one, as it would not turn to tlie risht. ■but only to the left. He had the second pony for about two months. Then he got a pony lent him which was quite : suitable. The price was £10. Witness sujr- i gested that defendant should take back ' the second pony, buy the third one for' plaintiff, and make £4 on the deal. ; Finally witness took the second pony back to defendant, who promised to pet him another one by the following Sunday. That was not done and witness offered" to accept £10 back, and let defendant retain the £4. Evidence was given by a horse trainer, that the second pony had a slipped shoulder two years ago, and would never , be right aarain. ; The defence was that the brown pony : . was sold outright to plaintiff, but as it . was too spirited, it was taken back, and . a cream one substituted. The cream ' one had taken prizes at shows. The '■ plaintiff agreed to take it- in exchange , for the brown pony. Plaintiff hroueht : ■ the cream pony back and the arrange- J ment was that defendant was to sell it j for him. : Mr. H.int gave judgment for the plain-] ' tiff for £10, Vith costs. '
