REPAIRS AND A COVENANT.
Mr. F. K. Hunt, S.M., gave judgment this morning at the Magistrates. Court, in a case n which Daniel Callinan (Mr. R. H. Mackay) sued Joseph Waters (Mr. G. Bennct) to recover fSO as damages for the failure of the defendant to carry out hie covenant to repair certain rented premises in St. Mary's Road, Ponsonby. Mr. Hunt was of opinion that the covenant was not wide enough to cover the cost of painting, which was part of the claim. Had the premises been let at a low rental in consideration of the tenant effecting extensive repairs, tbat should have been clearly' set out in the lease. Judgment was entered for the defendant ■ with, costs. Security for appeal was fixed at £10 10/.
