A PARTNERSHIP DISPUTE.
"A case concerning a. dispute over a partnership was heard before Mr. E. C. Cut ten. S.M.. yesterday, when Charles Henry Campbell (Mr. O'Donnell) claimed, from Clarence Nathaniel Xeuman (Mr. Xewberry) the sum of £22 10/ and 7/10 interest, being the first instalment of purchase money alleged to be due on a dissolution of partnership between them. The defendant eounter-vlaimed for £125 damages fur alleged misrepresentations made during the negotiations for partnership. Mr. O'Donnell stated that the plaintiff, currying on business at 88, Dominion Jtoad. under Hie name of "Tht» Crown Reinforced Concrete, Ltd.," on December 22 last sold a, one-third interest therein for £120 to defendant, and to one Beaven. In February partnership was dissolved, the defendant, agreeing to pay plaintiff £&O "by four equal payments of £22 10.'. Defendant took possession of the business, but, it was alleged, failed t<l pay the first instalment. It was further stated that dissolution stopped the defendant from setting up the misrepresentations allegeil Mr. Xewberry argued that the partnership had not been dissolved owing to a disagreement between the parties as to a covenant restraining the defendant from commencing business anywhere else in Xew Zealand.
After hearing lengthy evidence" fli« magistrate held that partnership was properly dissolved, and gave judgment for the amount claimed by plaintiff, with Co9ts on both claim and counter-claim, the defendant electing to l>e nonsuited on the counter-claim.
