■._ 9— , i DEVELOPING A COALMINE. LAND BY PROCLAMATION 1 , COMPE_7SATIO_T COURT ASSESSMENT. Judgment was given this morning by the Compensation Court, which considered the claim by the Public Trustee, as executor and trustee of the estate of the late Edwin Perrett, against the Hikurangi Coal Company, Ltd., arising out of the taking by proclamation of 8J acres of the estate for the development of the company's new mine. His Honor, fir. Justice Stringer, in delivering judgment, said: —"We award as compensation ta claimants on all counts the sum of £1700, with interest at the rate of'seven per cent per annum, computed fron October 11, 1921, the date'of the proclamation, to date. The claimant haying recovered less than one-half of his claim, is not entitled to costs." The costs of the two assessors, Mr. J. C. Martin, of Russell, and Mr. A. James, of Dunedin, were estimated at £31 16/. Mr. Myers, X.C, and Mr.-Broad appeared for the claimants, and Mr. Bichinond for the respondent company. The items of the claim were as follows' Eight acres, three roods of land, £1450f loss of way -leave payments, £6000; de« preciation of land left for subdivision, £150; value of coal left in land taken, £743; total, £5343.
