In a tenement case heard before Mr. J. W. Poynton, S.M., yesterday afternoon, A, J. Ward, builder, of Takapuna, proceeded against H. J. Platts, of Takapuna, for £18 11/ rest, and also for possession of a house in Lake Road. Mr. McXaV, on behalf of defendant, applied for a nonsuit on the grounds that n week's notice, which had been given, was insufficient, and that a month's notice was required. He aleo submitted that the claim for rent to date of judgment amounted to a waiver of the notice to quit.
