Sullivan applied, on behalf c ; f Ruby Karrington, of Auckland, for an order on Adjutant Annie Cordon, of the Salvation Army, and calling upon her to show cause «!iy a writ of habeas corpus I'M ('has. 11., Ch. 2, should not issue directing her to have immediately after receipt of the writ, before the Court. Dolly Violet Crlieh, alleged to be detained under Adjutant (kirdon's custody, together with the date and the cause of her being taken and detained. The" grounds of the application were that Dolly Violet Crlieh, the 12-year-old daughter of Ruby Karrington, was detained by Adjutant Gordon, and that Ruby Karrington was the girl's mother. The mother, in her affidavit, stated that she was married to Ceorge Steve Crlieh in 1008, and in loin" obtained a divorce and was given custody of the child, then six years old. For two years the mother had l>een on friendly terms with a Mrs. Dorothy Roberts, Auckland, and Dolly had resided with Mrs. Roberts on various occasions with witness' consent. As a result of the friendship existing between the two women. Dolly visited Mrs. Roberts' house on March 1, 1023. On March :: witness verbally requested Mrs. Roberts to deliver up the girl, but she had neglected to do so, and had encouraged the girl to remain with her. On "March ft witness got. her solicitor to write requesting delivery tip of her child, and subsequently learned that Mrs. Roberts bad handed the child over to Adjutant Gordon, of thp Salvation Army. 'On March !) witness had personally demanded Adjutant Cordon to deliver up the child, but the ollicer had refused to do so. His Honor granted an order, returnable at 0.30 on Monday.
