Osburne Lilly, instructed by Messrs. Mc- | Diarmid. Mears, and Gray), the sum of! .tlO.'i ."i :t. Defendant bad been partner' with another man, anil the latter being out of the district-action waa taken to recover from the member of the firm I mailable. It was claimed on behalf ofl defendant that plaintiff was not entitled to sue him personally on a partnership! account.
