The evidence having been taken, tin- parties moved for judgment, and these motions have been sent to the Court of Appeal for decision. The plaintiff asserts that having notice of its right... the purchase came within tho meaning of fraud under the Land Transfer Act. Tlie defendant company claimed that when it bought it was ollVrcd a clear title, and t hough knowing of the notice of appeal lodged it did not consider this would be prosecuted, and if it were its rights would not 'be affected. His Honor remarked during tin' hearing that the case was important in that it should decide what constituted fraud under the Act referred to.
