■ i AS AFFECTIUfG LAND SALE. CASE FOR COURT OF APPEAL. The suit of the Waimiha Timber Co.. Ltd.. in liquidation (Mr. W. D. Anderson and Mr. Endean), affainst the Waione Timber Co. Ltd. (Mr. Stanton and Mr. Cocker), for the determination of timber cutting rights on certain land in the King Country, which the defendant maintained wen' acquired by it by reason of its bona fide purchase of the property from one T. (I. <.'. Home, was concluded in the Supreme Court yesterday beforv Mr. Justice Herdman. The evidence having been taken, tin- parties moved for judgment, and these motions have been sent to the Court of Appeal for decision. The plaintiff asserts that having notice of its right... the purchase came within tho meaning of fraud under the Land Transfer Act. Tlie defendant company claimed that when it bought it was ollVrcd a clear title, and t hough knowing of the notice of appeal lodged it did not consider this would be prosecuted, and if it were its rights would not 'be affected. His Honor remarked during tin' hearing that the case was important in that it should decide what constituted fraud under the Act referred to.
