THEFT OF TOBACCO.

CHARGE NOT SUBSTANTIATED. ACCUSED ACQUITTED. A charge of breaking, entering and theft was preferred against George Mack in the Supreme Court yesterday before Mr. Justice Stringer and jury. " Mr. V. R. Meredith conducted the case for the Crown, and Mr. Leary for the accused. It was alleged that the accused broke into the premises of J. Kershaw Ltd., 48, Pitt Street, Auckland, on the night of July 1 last, and stole a quantity of tobacco and cigarettes to the value of £10. After hearing evidence, his Honor directed the jury to the effect that the Crown bad not proved that tho accused was actually the man who entered Kershaw's premises and stole goods The jury returned a verdict of not guilty without retiring, and the prisoner was discharged. i
